AdulteryWhile it is an explosive and emotional issue between the parties, adultery usually does not effect the division of property, alimony or children issues.  However, if promiscuity has led to the squandering of marital funds, or can be shown to have had a psychological impact on children, then it may have a bearing on child time sharing, and property division.  How much of a role marital misconduct will have in the judge’s mind depends upon the amount of psychological or financial damage the behavior has caused.
