Involving Personal Injury or Property Damage

As the public service commercials constantly remind us, drinking and driving often leads to crashes. An accident involving property damage or personal injury to another is more serious than simple DUI or driving with a blood alcohol level of .08 or higher. At this level, DUI is a First Degree Misdemeanor where the fine can be as high as $1,000 and jail time of up to one year can be imposed. Depending on the facts, e.g., a high speed chase and reckless driving leading to a traffic accident will, upon conviction, be treated more harshly than a lesser offense.
