Florida law imposes an obligation on every driver involved in a motor vehicle accident to remain at the scene, render aid if necessary, and give driver and insurance information. Failure to do so is a criminal offense. If the accident resulted only in damage to vehicles or property, the offense will be handled in the county court. The maximum punishment is a $500.00 fine or sixty days of incarceration. However, if the accident resulted in personal injury or death, the offense becomes a felony and is punishable by up to five years probation, $5,000.00 fine or five years imprisonment in the Department of Corrections. In addition, the Department of Highway Safety and Motor Vehicles is required to revoke your driver’s license.
