Florida law imposes an obligation on every driver involved in a motor vehicle accident to remain at the scene, render aid if necessary, and give driver and insurance information.  Failure to do so is a criminal offense. If the accident resulted only in damage to vehicles or property, the offense will be handled in the county court. The maximum punishment is a $500.00 fine or sixty days of incarceration. However, if the accident resulted in personal injury or death, the offense becomes a felony and is punishable by up to five years probation, $5,000.00 fine or five years imprisonment in the Department of Corrections. In addition, the Department of Highway Safety and Motor Vehicles is required to revoke your driver’s license.   Because these offenses are quite serious, it is suggested that you consult with a competent attorney before deciding how to handle your case.
